These Terms & Conditions govern your use of the avon-beach.co.uk website. PLEASE READ CAREFULLY AND REVIEW THE TERMS OF USE OF THIS SITE. Your use of the site will indicate your acceptance of these terms. If you do not accept these Terms and Conditions, you should leave our website now. We may periodically change the terms, so please check them from time to time as your continued use of the site signifies your acceptance of any changed items. If you are under 18, you can only use this site with the involvement of a parent or guardian.

This site is directed at United Kingdom resident customers only. If you are not resident in the United Kingdom Do Not Use This Site. We reserve the right to refuse to supply our products to you without reason.

Prices

Prices are as set out on the website and include VAT at the current rate. We reserve the right to alter prices at any time.

All payments will be taken via PayPal and we will not retain any details of your credit/debit cards.

Order Acceptance and Contract

We will notify you by e-mail as soon as possible to confirm receipt of your order. Orders placed by you are an offer to purchase and will be accepted by us, subject to stock availability. If something is not in stock, we will either let you know at the time of ordering or as soon after the order has been placed as possible. The contract for the sale of the goods will be formed when we send e-mail confirmation to you that we've dispatched the product to you at the address you provide us with. Acceptance will be complete at the time that we send this email to you.

All orders are subject to availability. We reserve the right to refuse to accept any order where there is a material error in the description of the goods or the advertised prices.

All goods shall remain in our sole ownership until such time as all monies payable have been received by us.

We take security seriously and have put in place appropriate physical, electronic and managerial procedures to safeguard the information we collect. Although we do our best to keep your personal information secure, we cannot however guarantee the security of your information transferred to our site. This website, its content and any contracts arisen out of it are governed by and in accordance with English law.

Your Statutory Rights

By law, customers in the European Union have the right to withdraw from the purchase of an item within seven working days after the date the item is delivered. This applies to all of our products except for the purchase of video, DVD, audio, video games, and software products where the item has been unsealed. Returned goods must be returned in good condition and in their original packaging. For your protection, we recommend that you use a recorded-delivery service. Please note that you will be responsible for the costs of returning the items to us unless we delivered the item to you in error, or if the item is damaged or defective. As soon as we receive notice of your cancellation of this order, we will refund the relevant part of the purchase price for that item together with the item's normal postage charge--we cannot refund any priority, express or courier component of the postage charge. Where goods are delivered to a third party you will only be able to exercise this right if you are able to return to us the goods you ordered. This does not affect your statutory rights.

Any customer wishing to cancel their purchase must do so on or before the seventh working day after delivery of the goods. Damaged or Defective Goods

If you receive an item that is damaged or defective, we will either replace the goods (or the faulty part of the item) free of charge or, at our sole discretion, refund to you the price of the goods (or a proportionate part of the price). Simply return the goods to us unused using the returns label provided with the goods.

Where goods are delivered to or received by you damaged or there is a shortfall, we must be notified within 14 days of receipt in order for replacement goods to be re-sent free of charge. No such claim will be accepted outside this time limit. Any such re-delivery is subject to the provision by you of such proof of damage or shortfall as we may reasonably require.

Delivery

Any quoted delivery times are estimates only. Time shall not be of the essence in the delivery of any goods.

Other than as set out above we accept no liability in relation to late delivery, damaged goods or any shortfall beyond the value of the goods in question.

The foregoing exclusions and limitations do not affect (and are subject to) those of your statutory rights as a consumer which cannot be excluded by law. For example, liability for Fraud or injury/damage caused by our negligence cannot be excluded.

These terms and conditions and any claims arising in relation to goods ordered or supplied shall in all respects be governed by English Law and any dispute arising under or in connection with the foregoing shall be for the exclusive jurisdiction of the English Courts.

Avon Beach Company Website intellectual property rights

All materials, including images, illustrations, designs, site layout, photographs, written and other text or script that are part of this site together with all software compilations, underlying source code and software in the site are protected by copyright, trade mark, design right and/or other worldwide intellectual property rights and are owned or controlled by or licensed to Avon Beach Company. Any use of this website or its contents, including copying or storing it, in part or in whole, other than for your own lawful, personal, non-commercial use is prohibited without the prior permission of Avon Beach Company. You may not reproduce, publish, transmit, publicly perform, distribute, display, modify, adapt, bundle, alter, create derivative works of the site, sell or participate in any sale of or exploit in any way, any of the contents, the site, or any related software in whole or in part without our express prior written permission. Any infringement of these rights will result in appropriate legal action.
